Agreed Upon Service

Thank you for choosing Business & Personal Accounting Solutions, Corp. to assist you with your tax needs for the prior financial tax year. This letter confirms the terms of my engagement with you and outlines the nature and extent of the services I will provide for this tax season.

Your Responsibility

I will depend on you to provide the information I need to prepare complete and accurate returns. I may ask you to clarify some items as a courtesy to you but will not audit or otherwise verify the data you submit. Yes, I understand tax preparation and my questions are to verify and clarify your data.

I ask several questions to verify data, and it is the best way to find all possible deductions for you that must be adequately and accurately documented. If at anytime the data is determined to be inaccurate, I will attempt to reach out to you for your help to obtain the correct data but it is your responsibility to provide accurate information. If however, you choose for me to continue without the corrected information or documents, you will need to respond via email stating you understand the possible negative tax impact. However, if I have to have the required information corrected but you refuse to respond or supply the corrected information your services will be terminated without refund, and the tax return will not be completed and released. Due to liability and unethical preparation issues, this is considered a violation of this Engagement Agreement.

Review your tax return

I will be happy to help you understand your return, but it is your responsibility to make sure we have accurate information and my responsibility is to make sure that information is entered correctly and adheres to the tax regulations and laws.

My Responsibility

I provide tax services. I will not perform accounting or bookkeeping services during tax season as this is essential and extensive time-consuming and requires detail outside of tax season. You can request full bookkeeping services at an additional charge after tax season. My work will not include procedures to find defalcations or other irregularities.  Accordingly, our engagement should not be relied upon to disclose errors, fraud, or other illegal acts, though it may be necessary for you to clarify some of the information you submit. I will inform you of any material errors, fraud, or other illegal acts I discover.

The law imposes penalties when taxpayers underestimate their tax liability. Please email me if you have concerns about such penalties. Should I encounter instances of unclear tax law, or of potential conflicts in the interpretation of the law, I will outline reasonable courses of action and the risks and consequences of each. I will ultimately adopt, on your behalf, the alternative you select.

My fee will be based on the time required at standard billing rates for each return type and schedule plus out-of-pocket expenses. Payments are due at the beginning of preparation. A late fee is $3.00 added every 7 days. Be aware that late payments will stop or delay work and impact others. Payment plans are allowed in certain situations and due payable before delivery of the completed return. Ignoring payment only delays preparation. If you ignore the email about payment and we reach my tax cut-off deadline I will have to hold the preparation until after tax season so I can move on to other clients. Tax returns will not be released until full payment has been received, a few exceptions are considered. Remember payments take two days to process and longer over weekends and holidays. I release tax documents after payment is received. Pay as soon as possible to avoid delay in delivery.

Terms of Service violations in

I will need timely documents, receipts, and various questions are required to determine the accuracy of your records. Incomplete data will create incomplete and inaccurate tax information. Please respond to requests for information as soon as possible. I usually request the information at least three days before I need the documents because I understand you will need to work it into your schedule. I will let you know the date I need the information in my request. If documents are not submitted or resistance to submission of documents is apparent on your part, your terms of the service agreement will be terminated. Usually, after 2 weeks of requesting without contact, you will receive a notice via email. You will not receive a refund. You will receive an invoice if a balance is due. The balance due is based on my hours worked and not a deliverable product once the contract is violated. Also, note that if your documents appear to be missing are inaccurate, and you fail to provide accurate information, your service will be terminated.

Upon Work Completion

If you submitted original documents (via mail)- I will scan them in and save a digital copy that I will share with you. I will also return your original records to you at the end of his engagement. You should securely store these records, along with all supporting documents, canceled checks, etc., as these items may later be needed to prove the accuracy and completeness of a return. We will retain copies of your records and our work papers for your engagement for seven years, after which these documents will be destroyed. Printed copies can be requested for $35.00. I maintain digital records and you can access your records at completion through my client portal.

Digital documents can also be maintained by a USB Drive (Jump Drive) that you purchase and is added to the cost of the tax preparation. You are responsible for the USB Drive. Download and save the return to the JumpDrive if you choose or mail in a drive each year with the documents. I am required to password protect your return or your folder.

Our engagement to prepare your taxes during the current tax season for the prior fiscal year will conclude with the delivery of the completed returns to you (if paper-filing) $45.00 for organizing, printing, and postage. Or conclude with digital delivery at a cost of $0 for your signature and our subsequent submission of your tax return (if e-filing).
